The idea for this book emanated from a series of judicial training courses for judges in the MENA region conducted by one of the authors for a number of years for the Commercial Development Program of the U.S. Department of Commerce. From these courses it became clear that there was a need for the education of judges in the region, not only practitioners and arbitrators, in various aspects of international arbitration laws and policies. Indeed, judges play an important role in the international arbitration regime, both at the pre-arbitration stage (knowing when to refer parties to arbitration and granting preliminary relief when needed), during arbitration proceedings (deciding jurisdictional issues, granting interim relief, assisting in the appointment of arbitrators, aiding in the enforcement proceedings). It also became clear that there were few resources in the Arabic language that would help judges to acquire the knowledge and skills needed to address these issues.
It was therefore decided to create a book on the subject of international arbitration specifically geared to the needs of judges in the region, although practitioners and arbitrators may also find the material useful. Since it covers so many topics it is not able to address each of them in detail but is rather intended to be a summary of the most important issues. The book is derived from an earlier text that was published in English in 2012 and revised slightly in 2018. However, instead of updating each chapter we decided to add a new chapter at the end which would discuss the most significant changes in arbitration law and policy since the initial text was published. Indeed, the field of international arbitration has grown enormously within the past few years with concomitant changes in policies, laws and the rules of major arbitral institutions. As an example, within the past four years all the major international arbitration centers have issued new rules, many of which address topics not covered in previous rules that have since become important. Accordingly, readers should be sure to read the last chapter of the book to see the important changes that have taken place which were not discussed in the previous text.
